1)All conditions of the Nevada County Sheriff, city police departments, and/or California Highway Patrol concerning traffic control in or around the filming site shall be observed as though recited herein. Filming on a state highway will require an additional permit from the California Film Commission; filming on a county road will require an “encroachment permit” from the Nevada County Department of Public Works (530) 265-1411. Filming in the incorporated cities of Grass Valley, Nevada City and the Town of Truckee may also require the approval of that city.
2)Permittee waives all claims against County, its officers, agents and employees, for loss or damage caused by, arising out of or in any way connected with the exercise of this permit and permittee agrees to save harmless, indemnify and defend County, its officers, agents and employees, from any and all loss, damage or liability which may be suffered or incurred by County, its officers, agents and employees caused by, arising out of or in any way connected with exercise by permittee of the rights hereby permitted, except those arising out of the sole negligence of County.
3)Permittee shall maintain in full force and effect commercial general liability insurance in the amount of $2,000,000, combined single limit, on a per occurrence basis and $4,000,000 general aggregate; worker’s compensation coverage, permits, licenses, registrations and leases/rentals during the terms of its filming operations. The Nevada County Economic Development Department, shall be notified not less than eight (8) working hours prior to the cancellation of any such documents. The liability insurance policy shall name the “County of Nevada, its officers, officials, employees and volunteers” as an additionally insured, as evidenced by an endorsement amending the policy.
4)Permittee shall not engage in operations on any public or private property without the written consent of the owner or occupant in possession, or upon any property not covered by this permit.
5)Permittee shall not discharge any toxic or hazardous substance into the environment and shall be solely responsible and liable for all identification, cleanup, remediation and removal to a proper disposal facility of any substances or materials determined to be classified as a hazardous or toxic material.
6)County shall have the privilege of inspecting the premises covered by this permit at any or all times.
7)This permit shall not be assigned.
8)County may terminate this permit at any time if permittee fails to perform any covenant herein contained at the time and in the manner herein provided. County agrees it will not unreasonably exercise this right of termination.
9)The parties hereto agree that the permittee, its officers, agents and employees, in the performance of this permit shall act in an independent capacity and not as officers, employees or agents of the County.
10)No alteration or variation of the terms of this permit shall be valid unless made in writing and signed by the parties hereto.
11)Permittee will not discriminate against any employee or applicant for employment because of race, color, religion, ancestry, sex, age, national origin or physical handicap.
12)The permittee hereby agrees to comply with all rules and regulations of the facility or institution subject to this permit.
13)Permit must be kept on site at all times.
14)Permittee shall remove, or leave in place, any permanent or temporary improvements, as directed by the property owner. If removed, the property shall, at minimum, be returned to its original condition absent the operations of the permittee. Permittee shall remove any and all debris, trash, etc. created as a result of its operations whether on public or private lands.
15)Permittee is requested to provide traffic control persons to permit the public use of Old Highway 40/Donner Pass Road during periods where the roadway is clear and where filming operations are not actively in progress.
16)Permittee is expressly advised of the extreme fire conditions existing at the time of the issuance of this permit and significant fire hazard thus created. Permittee shall be solely responsible and liable for any fire emergency created by its operations.
